This Policy supplements but does not supersede nor replace any other consents you may have previously provided to us in respect of your Personal Data, and your consents herein are additional to any rights which we may have at law to collect, use or disclose your Personal Data.

This Policy applies to Personal Data in our possession or under our control, including Personal Data in the possession of organisations which we have engaged to collect, use, disclose or process Personal Data for our purposes.

In this Policy, “Personal Data” refers to any data, whether true or not, about an individual who can be identified (a) from that data; or (b) from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time, but excludes “business contact information” as defined in the PDPA.

This Policy is subject to the laws of Singapore.

Generally, Capital Funds Investments may collect Personal Data in various ways including:

  • To carry out credit checks and other assessments of your credit-worthiness;

  • To verify your identity,

 

  • To process payment or credit transactions;

 

  • To manage our administrative and business operations (including the processing, storage, monitoring and backup of Personal Data);

  • Our related corporations and affiliates, either in Singapore or overseas; and

  1. How You May Withdraw Your Consent

Where you have provided us with your Personal Data, the consent that you provide for the collection, use and disclosure of your Personal Data will remain valid until such time it is withdrawn by you in writing. While we will respect any decision made by you to withdraw your consent in respect of our collection, use or disclosure of your Personal Data for any or all of the Purposes, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our services to you and we shall, in such circumstances, notify you before completing the processing of your request. Please note that if you withdraw your consent to our collection, use or disclosure of your Personal Data for any or all of the Purposes, such withdrawal of consent does not affect our right to continue to collect, use and disclose your Personal Data where such collection, use and disclosure without consent is required or authorised under the PDPA or other written law.

 

  1. How You May Access and/or Correct Your Personal Data Records

If you wish to request for access to a copy of any of your Personal Data that is in our possession or under our control, or information about the ways in which we have or may have used or disclosed your Personal Data, or to request for us to correct or update any of your Personal Data that is in our possession or under our control, you may submit your request in writing or via e-mail to our Data Protection Officer at the contact details provided below.

Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.

We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with access to your Personal Data, or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

 

  1. Accuracy of Personal Data

You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with certain services, or to enter into certain transactions with you. In order to ensure that your Personal Data is current, complete and accurate, please update us if there are changes to your Personal Data by informing our Data Protection Officer in writing or via email at the contact details provided below.

 

  1. Retention of Personal Data

We may retain your Personal Data for as long as is necessary to fulfil the Purpose(s) for which it was collected, or as required or permitted by applicable laws.

We will cease to retain any documents containing your Personal Data, or remove the means by which your Personal Data can be associated with you, as soon as it is reasonable to assume that the Purpose(s) for which we collected your Personal Data is no longer served by the retention of such Personal Data, and retention is no longer necessary for legal or business purposes.

 

  1. Transfer of Personal Data

If there is a need for us to transfer your Personal Data out of Singapore to entities linked and/or affiliated to Capital Funds Investments outside Singapore, we will ensure that we comply with the PDPA in doing so. If you provide us with any Personal Data relating to a third party, by submitting such Personal Data to us, you represent and warrant to us that:
